JAMB explains why candidates can no longer apply to two public universities

The Joint Admission Matriculation Board (JAMB) has disclosed why it restricted candidates from choosing two public universities during the 2017 online registration.
Fabian Benjamin, JAMB’s Head of Media and Information, Said In an interview on Saturday that the choice of public universities was restricted to one but candidates can choose as many colleges of education and polytechnics as they want.
The new measure by the board means that candidates may select a public university and a private university, but not two public universities.
The new update was revealed by JAMB via its official twitter handle @JambHQ on Friday.
It reads: “candidates can select NCE as their choice up to three times I.e 1st choice, 2nd choice and 3rd choice.
“But they are not allowed to select two public universities as choices. If candidates select a public university as their degree awarding choices, they are allowed to select a private university as another choice.”
Mr. Benjamin Said that the Board took the restrictions because candidates hardly get admissions into their second and third choice universities.
“Yes we restricted the choice to one but candidates can choose as many colleges or polytechnics,” he said.
“We discovered it was of no use choosing a university as second choice when in actual sense they can’t even accommodate their first choices,” the JAMB official said.
Candidates have however cried foul over this new information as they lamented that the board is indirectly enforcing the choice of private university on them.
The candidates also lamented due to the huge sum paid as school fees in private universities stating that they are not affordable by most Nigerian parents.
“The fees nko? Jamb go help the students pay the fees for the private universities? You can’t force somebody to attend private universities,” a Twitter user, Robinson said.

How MTN sacked 63 employees, barred them from related employment for four years

The telecommunication giant, MTN Nigeria, sacked 63 of its employees in 2009 and barred them from securing a job in the sector for four years, court documents obtained by PREMIUM TIMES has shown.
Last year, the National Industrial Court in Lagos, in a 2013 suit filed by the dismissed employees, delivered a judgment condemning the act and ordering the company to pay the workers four years gross salaries.
“Terminating the employment of the claimant and (at) the same time restricting them from seeking employment from the sector generally and preventing them to be acting as agents, advisers, or to engage in any of their concern directly or indirectly for four years is clearly unreasonable in the light of global economic challenges occasioned by recession which has resulted in mass unemployment,” Justice Peter Lifu stated in his judgement delivered on October 26, 2016.
“Consequently, I am satisfied that the claimant has proved their claims before the court as to the oppressive and unreasonableness of the restraint of trade covenant for four years for making and leaving the claimant hard and dry for four years.
“I hereby order that they are entitled to be paid their gross last salary per annum for the period of four years covering the period of restraint of trade as reflected in the salary review letters admitted as exhibit in this case.
“I also award a cost of N10,000 each in favour of the claimant as against the defendant in this action.”
But the company, in a response to PREMIUM TIMES inquiries, said claims that the employees were sacked were a misrepresentation because MTN merely exercised its right to terminate contract of employment.
Out of job
The suit against MTN Nigeria Communication Limited was instituted in 2013 by Harrison Ossai, Gabriel Ameh, and Stephen Mahaja on behalf of themselves and 60 others.
The claimants had sought an order of the court compelling the defendant to pay each of them N10 million as damages for trade restriction by the company from taking up employment from 17th November, 2009, to 17th November, 2013.
They also demanded a payment of N20 million from the company as cost of the court action.
Mr. Ossai, 43, a Higher National Diploma holder in Mass Communications, said he worked as a Call Centre Executive at MTN for six  years before his dismissal.
He said he had found it impossible to work anywhere else afterwards because of a restraint on trade covenant, adding that his job interviews at Airtel and Globacom were unsuccessful because of his MTN background.
While Mr. Ossai said MTN did not state the reasons for his dismissal, he insisted that a N100 million suit instituted by the company against a former employee, Yinusa Bello, for breaching the restraint on trade clauses was responsible for other telecom firms’ inability to employ him.
In their testimonies, Messrs Ameh, 53, and Mahaja, 43, said the restraint of trade clause was responsible for their failure at gaining employment after dismissal by MTN.
Nwamaka Okey-Aguoru, MTN’s witness in the suit, said she had not been employed by the company when the claimants were sacked.
Mrs. Okey-Aguoru said she doesn’t know about a matching order given to the claimants, who all worked in Customer Services department, to leave MTN’s premises on November 17, 2009, but added that she saw the letter of dismissal of the claimants.
Mrs. Okey-Aguoru, a senior manager, stated that the restraint of trade clause in MTN’s contract targets the company’s direct competitors such as Glo, Etisalat, and Airtel and covers a period of 48 months.
She said employees, who are under the clause, are not allowed to deal with MTN’s competitors when they leave the company.
Court documents showed that after Mr. Bello left MTN and secured a job in another telecom firm, the company slammed a N100 million suit on him for revealing market strategy, trade secret and design and confidential company information.
But the case was struck out at Lagos High Court, and later at the National Industrial Court.
Clause of controversy
In the 2013 suit, the claimants maintained that they were terminated and restrained, for four years, from seeking employment in any telecommunications company in the same line of business with MTN Nigeria Limited.
They had worked for the company for a period that ranged from five to nine years before the termination of their contract.
According to the Restraint of Trade Clause 17.3 in their contract with MTN: ‘You are required to sign the MTN Nigeria confidentiality agreement and any restraint agreement in existence from time to time.’
Paragraph 17.3.3 says, ‘The restraint set out in this agreement shall apply in the territories of the Republic of Nigeria, the Republic of Rwanda, South Africa, Uganda, the Kingdom of Swaziland or any other countries that MTN has investment in.’
Paragraph 17.3.4 says:
‘You shall not during the existence of your employment with the company and for a period of 48 months after the termination of your employment for any reason whatsoever, be directly or indirectly interested, engaged or concerned in, whether as a principal agent, representative, shareholder, director, employee, consultant, advisor, financier, administrator or in any competitor situated in the Federal Republic of Nigeria with whom the employee is involved or was involved in carrying out an assignment.’
Adeniyi Adegbomire, a senior advocate of Nigeria, who represented MTN Nigeria Limited argued that the claimants willingly entered into the agreement with the company.
“There is no existing evidence visibly to demonstrate that any of the claimants was denied employment at any time because of the restraint of trade clause,” he said.
Moreover, Mr. Adegbomire added, the clause never prevented the claimants from securing employment in other organizations in the telecommunications industry, except MTN’s competitors – Airtel, Etisalat, and Globacom.
But the judge disagreed with the lawyer.
Judge Lifu said four years is “a long time” and that Clause 17.3.4 in the claimants’ employment contract is an all-embracing and wide covenant on restriction of trade.
“The claimants also stated that they have not been able to get any employment in the telecommunications section which they have interest in to enable them consolidate their career but was prevented from doing so due to the restraint of trade clause which has kept them jobless for the period of four years,” Mr. Lifu said.
“Given that telecommunication is an emerging sector and given that young men and women are now restrained for four years as in the instance case, after termination, can a reasonable man say that such restrictive contract is not onerous?
“A man or woman should be free to exercise his skill, experience, expertise and knowledge to his own advantage, his family and the entire society. I think this accords with public policy.”
The judge noted that the claimants alleged their inability to pay rents and had incurred huge debts, but did not provide evidence to buttress their claim.
“There is therefore no evidence of untold hardship before the court,” he said.
“However, the law is clear as to the fact that where there is a right, there is a remedy.
“The claimants’ rights to exercise their skill, aptitude and knowledge have been breached by this repugnant, oppressive and unreasonable clause as contained in paragraph 17.3.4 of their letters of employment.”
The judge further stated that terminating the claimants employment and at the same time restricting them from seeking employment from the sector for four years “is clearly unreasonable in the light of global economic challenges occasioned by recession which has resulted in mass unemployment.
“Consequently, I am satisfied that the claimants have proved their claims before the court as to the oppressive and unreasonableness of the restraint of trade covenant for four years for making and leaving the claimants hard and dry for four years.”
After ordering the payment of the claimants’ yearly gross salaries for four years, the judge said the judgment should be complied with within 30 days, from October 26, 2016, or attract an interest of ten percent per annum.
No settlement in sight
In the course of the suit, the judge advised both parties to explore an out-of-court settlement, Adetunji Adedoyin-Adeniyi, who represented the dismissed employees, told PREMIUM TIMES.
“I went to the office of the (MTN) lawyer, that was in 2014… even while in London I was calling him, but the man was of the opinion that MTN has nothing to offer, that he cannot force them and what have you. So based on that position, we went through the case, thick and thin.”
Mr. Adedoyin-Adeniyi said he contacted MTN Nigeria Limited after the judgment.
“I wrote a letter to the MD of MTN and their Human Resource (Manager), that we have a judgment, please do this. Despite the fact that they were fully heard in court, for the three years we were in court, MTN still went ahead to say they are appealing the case,” he said.
“And what do you say you are appealing? You are appealing the judgment of the National Industrial Court when under Section 243 of Third Amendment, they don’t even have a right to appeal the judgment except on grounds of fair hearing, that you can now say I was not heard.”
Mr. Adedoyin-Adeniyi said despite MTN not responding to their letters, they are still willing to explore an out-of-court settlement with the company.
“We don’t want to belabour this thing, all we are interested is just give them something and let’s move on. Nothing has been fruitful, maybe God in heaven will see to it.”
But MTN Nigeria Limited said they had entered a formal appeal at the Court of Appeal.
“It should be noted that contrary to misrepresentation around the ‘sack’ of employees, the correct position remains that MTN had exercised a right to terminate contract of employment which said right was also readily available to all its employees,” Funso Aina, PR and Protocol Manager, Corporate Services Division, MTN Nigeria said in an e-mailed response to PREMIUM TIMES.
“MTN had also, as required by law, paid salary in lieu of notice and for the record, paid over and above the required one-month salary in lieu of notice by paying three months’ salary to the concerned employees. This was in addition to waiving all outstanding financial obligations owed MTN by the employees.”
Mr. Adedoyin-Adeniyi said immediately after the National Industrial Court judgment, he filed an application to garnishee the company’s bank account.
“Because when we did our calculation, we realized that the money, it’s about N850 million they were supposed to pay; MTN now filed an application for stay of execution and the court granted it,” he added.
The garnishee case at the National Industrial Court has been adjourned until further notice because of the notice of appeal filed by MTN Nigeria Limited.
The Court of Appeal is yet to give a hearing date.

Ibrahimovic Stalls On Extending United Deal Over Champions League Qualification


Manchester United striker, Zlatan Ibrahimovic, is stalling on signing a contract extension with the club, over concerns they might not qualify for the Champions League.
United are currently sixth in the Premier League, outside the top four places.
According to MirrorSport, Ibrahimovic is reluctant to go a second season without playing in Europe’s top club competition.
The Swedish striker turns 36 in October and believes next season could be his last at one of Europe’s top clubs, before he heads to the MLS.
United, however, have a second route into the Champions League, if they win the Europa League. Jose Mourinho’s men have been drawn against FC Rostov in the quarter-final of the competition.

Premier League!! Chelsea 3-1 Swansea City (RESULT)


Chelsea stretched their lead at the top of the Premier League table to 11 points after victory over battling Swansea City at Stamford Bridge.
Cesc Fabregas marked his 300th Premier League appearance by putting the Blues ahead, poking the ball through the legs of Jack Cork and into the net.
The hosts were stunned when Swansea equalised from their first serious attempt on target on the stroke of half-time – Fernando Llorente heading in Gylfi Sigurdsson’s free-kick.

Why I’m shooting 10 Days in Sun City – Comedian AY

Talented Nigerian comedian and filmmaker, Ayo Makun, aka AY, recently shot a beauty pageant scene in his latest movie, 10 Days in Sun City at the Federal Palace Hotel in Lagos.
PREMIUM TIMES had a chat with the funny man at the location and he opened up on his winning formula, love for film-making as well as his vision for the “Akpos” franchise.
PT: The adventures of Akpos appear to be a never-ending story. What is unique about 10 Days in Sun City?
A.Y: 10 Days in Sun City is another Akpos franchise and one of the series of his adventure. This time around Akpos decides to go to Sun city in South Africa to have some fun. It’s a romantic comedy laced with so much excitement. The idea is also to do our usual collaboration, which is all about having a blend between Nigeria and other countries and this time it has to be South Africa.
PT: Tell us more about the film?
AY: It is shot in Sun City, Johannesburg and Lagos. The hilarious star-studded comedy movie features A-list movie cast from Nigeria such as Richard Mofe-Damijo, Adesua Etomi, Mercy Johnson, Falz The Bahd Guy, 2Baba Idibia, Gbenro Ajibade, Fathia Balogun, Uti Nwachukwu, Yvonne Jegede and Alexx Ekubo to name a few.
The movie also features Miguel Nunez Jr. from Hollywood and hilarious South Africa cast that includes the sensational Amanda Du Pont, comedienne Thenjiwe Moseley, Celeste Ntuli and lots more.
PT:…and the plot?
AY: 10 Days in Sun City’ is a potpourri of love, drama, passion and culture combined with generous portions of comedy. The movie is a feature-length comedy-drama that sees Akpos on another “adventure”, this time, to South Africa, with his girlfriend Bianca.
Bianca is a campus beauty queen who he (Akpos) has sacrificed his livelihood to make successful. After successfully winning a national beauty pageant, BIANCA, ever loyal to Akpos, is now an international celebrity rolling with society’s ‘high and mighty’. She is, amongst several mouth-watering corporate endorsements, global ambassador to, and the face of multi-national cosmetics conglomerate ‘OTAWI’ which is owned by Nigeria’s richest man, Otunba Ayoola Williams, aka ‘The Old Fox’. To Otunba, Bianca represents more than the face of his company, he has plans for her to play a bigger role in the business as well as in his ‘life’. So Otunba decides to embark on the same journey to South Africa. Bianca has no idea what lies in store neither does Akpos. I can’t reveal more.
PT: You have had back-to-back hits with your films and most recently broke your own records. What will say is your winning formula?
A.Y: It has little or nothing to do with spending so much on a film because some people spend much less and make so much returns. The idea to get it right is to spend money in doing the right thing. Gone are the days when we took the audience or viewers for granted with the belief that you can give them just anything. Right now, you cant just feed anyone with any film and think they will accept it. For that reason I made a primary decision that our passion is well established in terms of content and the arts generally.
PT: Many are of the opinion that comedy no longer pays you hence your focus on film-making.
AY: That’s a big lie because year in and out, I have hosted my AY Show in London, Lagos, Abuja, Port Harcourt and other parts of the world. This (filmmaking) is just a part of the business. It’s always good to diversify as an entertainer because you have the franchise to explore different areas in the entertainment circle. Personally, I can’t sing and that is the only area I won’t venture into but marketing entertainment, doing movies is a total package for me. It makes no sense for people to think that because I’m doing movies I have decided to stop stand up comedy. Kevin Hart is an actor and big time moviemaker. Steve Harvey is a stand-up comedian, a radio talk show host and a stand up comedian. From Chris Rock to Eddie Murphy, the list is endless. People should just learn to accept entertainers and if Dbanj decides to act today it shouldn’t be attributed to the fact that Banky W had a successful debut in acting.
PT: Why must it be a Trip to Jamaica, 30 Days in Atlanta and now 10 days in Sun City?
AY: Akpos loves adventure and he loves travelling around the world. We can’t shoot 10 days in Warri because there are over 4000 Akpos in Warri. Nigerians love to know how their friends and loved ones in other environments and some people haven’t seen or experienced other cultures and practices in other countries like Jamaica. But, such persons will know that you will see it in the movie through the eyes of Akpos. When people ask must I travel abroad to shoot a film? I simply tell them that this is my style. A winning team is a winning formula and I can never change it until when I feel its time to do something else. I know I can’t shoot a horror movie in this part of the world and that is why comedy gives me that extra edge.
PT: Why the choice of Adesua Etomi as your love interest in 10 Days in Sun City?
AY: I chose to star her in the film because she is gorgeous and beautiful. We are shooting a movie that has to do with a beauty queen and when you look at the industry who and who can you present as a beauty queen. We are not saying who is beautiful but who has the qualities of a beauty queen. Adesua fits perfectly into the role.
PT: How much has 10 Days in Sun City gulped so far?
AY: It’s not a figure that I can put together at the moment but it is a whole lot of money. The budget is three times bigger than what I have ever expended on a movie. For instance, this location is a set for a scene in the movie that will not last more than 6 minutes. That is to let you know where we have decided to take this industry.
PT: When is the film premiering at the cinemas?
AY: The premiere will be in June, in summer.

#BBNaija: While ThinTallTony claims being single, pictures of wife, kids go viral

Hours after ThinTallTony (TTT), one of the housemates who survived eviction from the #BBNaija told Bisola, a fellow housemate, that he was single, pictures of his family went viral on the internet.
The family pictures uploaded from his Facebook page showed that TTT is married to Laraba Offiong and blessed with two adorable children.
TTT and Bisola have been getting cozy with each other for some days now and they have confessed to having feelings for each other, although it seems Bisola doesn’t know TTT is married as he never mentioned it.
Bisola had inquired about his marital status and he replied that he is single by God’s grace, thus presenting himself as an unmarried man.
This has evoked reactions from Nigerians as they feel he is deceiving Bisola and has hurt his wife.
Meanwhile, ThinTallTony’s wife continued to campaign for him on her Instagram page even as he survived the Sunday eviction, clearly indicating that he is married.

Volleyball: Nigerian teams qualify for World Championships

Nigeria’s under-21 beach volleyball teams have qualified for the 2017 FIVB Beach Volleyball Under-21 World Championships scheduled for Nanjing in China from June 13 to June 18.
Habu Gumel, President of the Nigeria Beach Volleyball Federation, NVBF, who broke the news on Monday in Abuja said both the male and female teams qualified for the championships.
The teams had campaigned for the tickets at the Zone Three qualifiers held in Lome, Togo from February 10 to 12.
They competed against teams from Togo, Ghana and Benin Republic, with Nigeria parading two teams each in both the male and female categories.
While the Nigerian female team finished first in the female category, the male team were second in their own category.
Speaking on the teams’ success, Gumel said his Federation was happy with the performance, especially as it was in line with the teams’ rating on the continent.
“We expected the teams to do well in Togo, in view of their ratings as number two (female) and number five (male) on the continent, and the players did not disappoint us,’’ he said.
Gumel, who is also President of the Nigeria Olympic Committee , however said the NVBF deserved praise for making efforts to camp the teams to fine-tune their preparations for the qualifiers.
           “I believe the camping of the teams in Abuja last week went a long way in not only boosting their morale but also in preparing them better for the task.
“Being in camp to prepare is always a good way of preparing players and teams, and we did just that in order to achieve results, even though it was at a cost.
“But we thank God that we got what we wanted from it,’’ he said.
The NVBF president, who is also Nigeria’s lone member on the Executive Committee of the International Olympic Committee, IOC, assured that the Federation would now go on to prepare the teams for the world championships.
“Now is the time to start to prepare for the world championships, and we will start from today to put in place all that we need to prepare the teams.
“That is the only way to get the teams ready for success, through early preparation, and we shall continue to do that,’’ he said.

Mr. Buhari is on medical vacation in London, and there has been widespread speculation about his health.

At exactly 2.43 p.m today, Saturday, February 25, 2017, my phone rang. Who was at the other end? Tunde Sabiu, personal assistant to President Muhammadu Buhari.
“Hold on for Mr President,” Tunde said.
And in a matter of seconds, the very familiar voice came:
“Femi, how are you?” (He calls me Adesina most times, but today, he opted for Femi)
I screamed :”Mr President, I have missed you. How are you sir?”
    He first laughed. That familiar laugh. Then he said: “I am still resting. Thank you for holding out against mischief makers.”
I said it was my duty, the very least I could do, adding how happy I was to speak with him.
“How is your family?”
I said we were fine, and he asked me to extend his greetings to them.
“I hope to call you again, ” Mr President said, and I bade him farewell, adding: “Best wishes, sir.”
It was a defining moment for me. For more than a month, I had always spoken with aides who are with the President in London.
Not once did I ask them to take the phone to him, deliberately so, because I didn’t need to speak with him to validate the fact that he was alive. And since he was on vacation, he had a right to his privacy.
Of his own volition, President Buhari spoke with me. It made my day. Even if he hadn’t done so, he would have remained my President, my leader, and my man. Any day.

Wayne Rooney Finally Makes Decision On Big Money Move To China


Wayne Rooney has confirmed he is staying at Manchester United despite reported interest from the Chinese Super League.
Reports this week have claimed Rooney’s agent, Paul Stretford, travelled to China to negotiate with Chinese clubs potentially ready to offer the England captain a lucrative exit from the Premier League.
The Chinese transfer window remains open until the end of February, meaning a deal could have been struck with immediate effect. But United’s all-time top goalscorer has now revealed that he wants to remain at Old Trafford as the Red Devils continue their participation in the league, FA Cup, League Cup and Europa League.
In a statement released to the Press Association, Rooney said: “Despite the interest which has been shown from other clubs, for which I’m grateful, I want to end recent speculation and say that I am staying at Manchester United.
“I hope I’ll play a full part in helping the team in its fight for success on four fronts. It’s an exciting time at the club and I want to remain a part of it.”
On Wednesday, Tianjin Quanjian coach Fabio Cannavaro admitted his club had approached Rooney but ruled out a move on the grounds that he did not fit his preferred style of play.
Beijing Guoan have been linked with the 31-year-old on the basis that they remain under the quota of foreign players allowed in the Chinese league, though Jiangsu Suning had also been tipped as a possible destination despite currently being at the limit.
Rooney has scored two goals in 17 league matches this season, eight of which have been starts.
He began the campaign as a member of Jose Mourinho’s starting XI but has since fallen out of the lineup, with Zlatan Ibrahimovic now the club’s first-choice striker and Paul Pogba and Henrikh Mkhitaryan bolstering the midfield.

A breakthrough has finally been made in the fight against HIV/AIDs as five HIV patients are virus-free seven months after taking a new vaccine. According to a report by Dailymail, the treatment, developed by researchers in Spain, allowed the patients to stop taking regular antiretroviral (ARV) drugs – the current method of suppressing HIV.
Scientists have yet to test the results in a large-scale clinical trial, but they say the vaccine may be a ‘functional cure’.
It is the first step towards success in a field that has failed to find a vaccine in the last 30 years.
‘It’s the proof of concept that through therapeutic vaccination we can really re-educate our T cells to control the virus,’ says Dr Beatriz Mothe, from the IrsiCaixa AIDS Research Institute in Barcelona, Spain.
‘This is the first time that we see this is possible in humans.’
The search for an AIDS vaccine has generated massive investments and intensive efforts but, so far, not one vaccine has come to market.
After efforts and investments attempted and failed to bring a vaccine mainstream that would prevent HIV infection, researchers decided to test therapeutic vaccines.
They aim to help infected people keep the virus at bay for months or even years without ARV drugs.
Dr Mothe and her colleagues used an HIV vaccine made by Professor Tomáš Hanke from the University of Oxford in the UK. The study included 13 participants who had taken ARVs for a little over three years on average – all within six months of being infected.
The researchers theorized that although the drugs kept down HIV levels, it limited the virus’s ability to integrate into their chromosomes, leaving them with relatively small ‘reservoirs’ of infected cells.
This should make it easier to contain the virus if the drugs are stopped, especially with the help of a vaccine, they said. Scientists injected the participants with a series of three shots of the vaccine and they stopped taking ARVs.
After four weeks, eight of the patients saw the virus rebound. But the other five patients have gone six to 28 weeks without having to restart the treatment.
The virus became temporarily undetectable, but it has never gone above 2,000 copies per milliliter, which is the criterion to restart treatment. Of the more than 50 therapeutic vaccine trials so far, this is the first one that has bolstered the immune system in a ‘meaningful’ way, according to Dr Steven Deeks, an HIV/AIDS clinician and researcher at the University of California, San Francisco.
He is ‘cautiously optimistic’ that the data will inspire others to study the approach.
Immunologist Dr Daniel Douek, of the National Institute of Allergy and Infectious Diseases in Bethesda, Maryland, is far more skeptical.
‘The results are encouraging, but it is difficult to gauge what the effect of the procedure actually was because of the uncontrolled nature of the study and the fact that the people who remain off [ARVs] are, nevertheless, viremic,’ Dr Douek said.
But Dr Mothe said that previous ‘treatment interruption studies’ – in people who started ARVs soon after becoming infected – have found that only 10 percent of their infections under control for longer than four weeks.
In the Barcelona study, the rate was 38 percent. HIV notoriously dodges immune attacks – and preventive vaccination – by mutating.
The researchers believe the trial’s partial success may be because the vaccine contains HIV genes that code for ‘highly conserved’ internal structures and enzymes that cannot change much without harming the virus.
Dr Deeks said: ‘Should the current trends persist, it is hard to argue that the vaccine strategy did not do something, but controlled studies are needed.’
